US EPA urges registrants on fish protection

 The US EPA has called on the registrants of three organophosphate insecticides to indicate by May 13th whether they intend to adopt “all or some” of the use restrictions laid down by the Agency last year to protect endangered salmon in four states. The EPA requested Cheminova, Dow AgroSciences and Makhteshim-Agan Industries to adopt the restrictions following modifications to the recommendations in a biological opinion (“BiOp”) issued by the National Marine Fisheries Service.
The Agency has made some adjustments to its protective measures in light of comments made by the registrants. They include modifications to the buffer zone calculator and a change to wording on reporting fish kills. However, the restrictions are essentially unchanged. The EPA rejected a suggestion to exempt the use of malathion for mosquito control and refused to redefine the types of water courses to which buffers would apply. It also rejected claims that there had been a lack of transparency and opportunity for input to the BiOp implementation planning, and denied that the bulletins detailing the restrictions were misleading.
In a letter to the registrants, the EPA says that it is prepared to receive their decisions on which aspects of the amended bulletins they are willing to adopt on a voluntary basis as use limitations for their products. It would then work with the registrants on the process of changing product labelling. However, if they are not willing to adopt all of the limitations, the Agency will pursue administrative measures under federal law to compel implementation.
In January, the registrants filed a petition with the EPA calling for more transparent procedures in the establishment of use restrictions to protect endangered species. Last month, the companies were joined by the industry association, CropLife America, in notifying the Agency of their intention to take legal action over the procedures.
